These Terms govern your use of thenovax.com and Switchboard cloud services operated by NOVAX. By creating an account or using the cloud features, you agree to these Terms and our Privacy Policy. This is not legal advice.
Switchboard is a desktop application and optional cloud layer that helps creators manage social sessions, capture feeds locally, connect AI agents via MCP, and (if enabled) sync selected captures to NOVAX cloud for Intelligence and analytics.
NOVAX is not affiliated with, endorsed by, or an official partner of Meta, Instagram, Threads, X, LinkedIn, Reddit, Facebook, or other third-party platforms unless we expressly say so in writing.
You must provide accurate registration information, keep credentials secure, and accept these Terms and the Privacy Policy. You are responsible for activity under your account.
We may suspend or terminate accounts that abuse the service, attempt to bypass security, or create legal or operational risk.
Social networks have their own Terms of Service, community guidelines, and automation/scraping policies. You are solely responsible for ensuring that your use of Switchboard—including browser automation, feed capture, posting, liking, commenting, and any agent-driven actions—complies with those platform rules and applicable law.
Unofficial automation or bulk collection may violate platform terms even if Switchboard makes the action technically possible. We may disable features that create elevated risk, but we do not warrant that the product is authorized by any platform.
Feed captures and cloud Intelligence may include text, usernames, metrics, and media URLs originating from third parties. You represent that you have the right to capture and, if enabled, upload that data under your platform agreements and local law.
Public pages may show anonymized or aggregated examples. Authenticated APIs may expose more detail to eligible users. We do not claim ownership of third-party social content. Marketing displays are illustrative and may be incomplete or delayed.
AI drafts, labels, and insights are probabilistic. You must review outputs before publishing. You remain responsible for any content you post to third-party platforms.
Paid features (such as higher AI quotas or Intelligence access) are billed through Stripe under the prices shown at checkout. Fees are generally non-refundable except where required by law or expressly stated.
You may not use the service to spam, harass, deceive, scrape beyond your lawful rights, attack systems, reverse engineer in violation of law, or redistribute shared pool data in a way that re-identifies individuals on public surfaces without a lawful basis.
You may not misrepresent Switchboard as an official API client of a social platform.
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED ACCESS, PLATFORM COMPATIBILITY, OR THAT AUTOMATION WILL NOT TRIGGER PLATFORM ENFORCEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVAX AND ITS SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ACCOUNT BANS, CONTENT REMOVAL, OR LOST PROFITS ARISING FROM YOUR USE OF THE SERVICE OR THIRD-PARTY PLATFORMS. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM.
You agree to indemnify and hold harmless NOVAX from claims arising out of your content, your platform automation, your violation of these Terms, or your violation of third-party rights or platform rules.
We may update these Terms by posting a new version with an updated date. Continued use after material changes constitutes acceptance where permitted by law.
